Oregon Tilth offers services to further evaluate USDA National Organic Program NOP certified crop and handling operations with European Union (EU) organic standards. This enables OTCO operators whose NOP certified crops and products to be sold to a processor, handler or distributor exporting to the EU.

Evaluation of equivalence is done through the use of a set of Private Standards titled ACB EU Equivalent Standard. For operations who need this service, operators will need to submit an International Supplement with their Organic System Plan. After evaluation, OTCO will issue a Declaration of Compliance that allows the sale of organic products as EU-compliant for crops and products that meet the EU standards. Please note that OTCO no longer offers this EU certification to operators within the US or Canada.

Since the EU and NOP Equivalency arrangement in 2012 and other Equivalency arrangements with the EU and Canada, only certain operations need to apply for the additional EU Certification service. If you are in the U.S. or Canada, your products and sales likely fall under these equivalency arrangements. EU and NOP Equivalency Arrangement

On February 15 2012, the National Organic Program [NOP] and the European Union [EU] signed a bilateral Equivalency Arrangement. This historic arrangement between the worlds’ two largest organic markets will give NOP certified Farms and Handlers in the United State export and import access to the European organic market.

OTCO Certified Operations in the U.S. DO NOT need additional EU Certification if:

  • Operations are located in the United States and export to the EU
  • Sell to an NOP certified operation in the US who exports to the EU

OTCO Certified Operations in the U.S. DO need additional EU Certification or Verification if:

  • Operations export apples and pears or products containing apples or pears to the EU that were produced prior to 12/14/2015
  • Operations supply products to additional EU certified operations in foreign countries (beside US and EU)

OTCO Certified COR Operations in Canada DO NOT need additional EU Certification if:

  • Operations export products to the EU that are 100% grown in Canada
  • Operations sell to an NOP certified operator in the U.S. who further process the product and exports directly to the EU

OTCO Certified COR Operations in Canada DO need additional EU Certification if:

  • Operations export to the EU that are NOT 100% grown in Canada
  • Operations supply product to EU certified operators in foreign countries besides the U.S. and EU

OTCO NOP Certified Operators outside of the US and Canada DO NOT need additional EU Certification if:

  • Operations sell to and NOP certified operator in the US who final processes the products and exports to EU

OTCO NOP Certified Operations outside of the US and Canada DO need additional EU Certification if:

  • Operations export directly to the EU from your country
  • Operations supply product to EU certified operators in foreign countries besides the U.S. and EU

Exporting to the EU- International Trade Documents

Every shipment of product exported to the European Union requires a transaction document called a Certificate of Inspection (COI). The COI is a load specific document that must be present in order for the product to clear customs. The US and EU, as well as Canada and the EU each have a bi-lateral Equivalency Arrangement with additional certification requirements. Products exported to the EU that are outside the scope of the Equivalency Arrangements must be certified to the EU regulations.
